Our client was a labourer who experienced aching in his hands, feet and knees during 2010 whilst he was laying pipes during his employment. It was not until three years later that our client was formally diagnosed with fibromyalgia and chronic pain syndrome. His symptoms were not a classical presentation of his condition.
Due to our client’s diminished functional capacity, he was unable to return to work since the onset of his symptoms. When drafting submissions, the solicitor argued that our client was unlikely to ever return to work for which he had the education, training and experience because our client had spent the preceding twenty years solely in the manual labour field. The physical pain he continually suffered would, therefore, inhibit his prospect of such employment in the future.
Vigilant investigations were undertaken, and the claim was lodged with extensive medical evidence demonstrating the severity of our client’s injury. When the fund continued to request further information or documents which they had already been provided, the solicitor considered these intermittent requests to have resulted in the delay of the decision of a legitimate claim. The solicitor pressured the fund to expediate their determination and remained on the ball during the entire process by seeking updates from both the fund and various third parties to ensure our client would receive the benefit.
The claim was approved, and our client was thrilled that his claim had been settled. The insured value of the TPD benefit at the event date was $130,800.00.
