Total permanent disability claims (TPD) can be somewhat complex and at times confusing. There are times when society provides ample opportunity to refer to instances that explain it perfectly. Such a case occurred recently when NSW Premier Mike Baird broke his back at home.
Baird fractured his vertebrae when he slipped and fell down the stairs at his home during the middle of the night. Posting on his Facebook page, Baird said he slipped as he went downstairs in the dead of the night, wearing only socks.
The injury hasn't prevented Baird from working at all, but has people thinking about circumstances where they suffered their own injuries and couldn't work.
Knowing whether or not you have a TPD claim
What constitutes a legitimate TPD claim is a question we're often asked at Gerard Malouf and Partners. One important and consistent factor is the time when you suffer the injury that prevents you from working.
You can be declared permanently or totally disabled if you are suffering from a serious injury for six or more months on a continuous basis. More often than not, you will be asked to prove you're unable to work at all due to your injury. This is in spite of you having the necessary skills to perform the duties of your role if you were uninjured.
Making a TPD claim can sometimes be an intimidating or overwhelming prospect, especially if you're not sure about what you're dealing with. That's why it's imperative you speak with people in the know, who are familiar with the processes.
